“Dual employment” or “dual appointment” refers to an NYU employee holding more than one appointment, concurrently, with the University.
Regarding NYU-NY, an employee covered under a collective bargaining agreement between the University and Local 1, 30, 153, 3882, or 810 may not simultaneously hold a dual appointment as an Administrator/Professional, Professional Research Staff, or Faculty.
All other variations of dual employment/dual appointment are subject to the University’s conflict of interest and commitment policies, and, at a minimum, require that the Human Resources Officer/Business Partner (“HRO”) for the employee’s primary appointment provide approval* to the HRO for the employee’s dual appointment.
Please note the employee may not begin working until we have approved the appointment and a separate timesheet is created. If approved, dual employment work must be performed in the office. Dual employment work must not be performed remotely.
The dual employment hourly rate must be the same as the primary appointment hourly rate. *MyTime will calculate the overtime rate automatically if the employee works more than 35 hours per week among all jobs.
Please also keep in mind the following information for clerical and technical union employees:
Meal Breaks- When an employee works overtime and their shift begins before 11am and ends after 7pm, the employee is entitled to an additional meal period of at least 20 minutes between 5pm-7pm. If the meal period is 30 minutes or less, it should be paid.
Note: The standard noonday meal period should still be 60 minutes, except in extenuating circumstances in which a 30 minute meal break is necessary. If a 30 minute meal break is taken, arrangements for 30 minutes of Compensatory time should be made.
Time Between Appointments – The employee must begin their work in dual employment at least 30 minutes after the work shift for the primary job, e.g. the employee must start working at 5:30pm or later if their schedule for their primary appointment is 9:00am - 5:00pm.
* If an employee's time at all University jobs and/or temporary additional assignments totals more than 35 hours worked, s(he) must receive overtime pay, as required by Federal Law.
In order to obtain approval for a dual appointment, you must complete the Dual Appointment Request Form.
FAS HR will review the information and send you an e-mail confirming approval. Once we have approved this dual employment appointment, an additional timesheet will be created to track the hours for this assignment.
